Affiliate program agreement

This agreement defines the rules of affiliate cooperation within the EmiliAliston.com portal. The agreement can be concluded electronically in the user panel of the EmiliAliston.com portal.

1. Subject matter of this agreement

The contract is concluded between the user of EmiliAliston.com, hereinafter referred to as “Affiliate”. z Vendor - a natural person conducting business emilialiston@gmail.com.

1.1. The Seller agrees to provide the Affiliate with a unique referral link, which will promote the Seller's products.
1.2. The Affiliate agrees to place the Seller's advertising materials on its website website or in other marketing channels
1.3. The Affiliate will receive a commission for each sale made by a customer who created an account on the site of the Merchant through the Affiliate's links.

2. Duration of the contract

2.1. The contract is effective from the date of acceptance by the User for a period of 12 months.
2.2. The contract can be extended for another 12-month period if both parties agree to it.

3. Commissions

3.1. The affiliate will receive a commission of 30% on the value of each video sale made by the customer, who came to the Merchant's website through the Affiliate's links.

3.2 Commission Structure for Sales

(a) Emili Aliston Content. For sales of films and other paid content authored by Emili Aliston, the Partner earns thirty percent (30%) of the amount charged to end users for the relevant item(s). If applicable taxes are itemized separately at checkout, the amount charged shall be understood exclusive of such taxes.

(b) Other Creators’ Content. For sales of content authored by creators other than Emili Aliston, the Partner earns thirty percent (30%) of the Platform Fee, where the Platform Fee equals twenty-three percent (23%) of the amount charged to end users for the relevant item(s). If applicable taxes are itemized separately at checkout, the amount charged shall be understood exclusive of such taxes.

(c) Illustrative Example. Creator XYZ earns PLN 300 from a live stream. The Platform charges viewers PLN 369. The Platform Fee is PLN 369 − PLN 300 = PLN 69. The Partner’s commission is 30% of PLN 69 = PLN 20.70. The Partner therefore earns PLN 20.70.

(d) Adjustments. Commissions are calculated on payments actually collected and not refunded, and are reversed for refunds, chargebacks, voids, or fraudulent transactions. Rounding is performed to two decimal places in PLN.

4. Settlement rules

4.1. Commissions will be paid to the Affiliate upon request submitted to email: emilialiston@gmail.com

5. Complaints and returns policy

5.1. Customers will submit complaints and requests for refunds directly to the Seller.
5.2. Affiliate will not be responsible for complaints and returns

6. Data protection

6.1. The parties undertake to comply with applicable data protection legislation personal data.
6.2. The Seller will process customers' personal data in accordance with the privacy policy available on the Vendor's website.
6.3. The affiliate will process customers' personal data in accordance with the privacy policy available on the Affiliate's website

7. Termination of contract

7.1. The contract may be terminated by either party at any time without cause.
7.2. In the event of termination of the contract, the Affiliate agrees to remove advertising materials Vendor from its website or other marketing channels.

8. Final provisions

8.1. This agreement constitutes the entire agreement between the parties and supersedes all prior agreements arrangements.
8.2. The contract can only be amended in writing and signed by both parties.
8.3. The agreement is governed by Polish law.
8.4. Any disputes arising from this agreement will be settled by the court having jurisdiction over the seat of the Seller (Poland)
